These Terms of Service ("Terms") govern your access to and use of the Heart Condition: Tended, Kidney Condition: Tended, Diabetes: Tended, and Memory & Cognition: Tended mobile applications (the "Apps") operated by Tended Tracking. By using our Apps, you agree to be bound by these Terms.
By creating an account or using our Apps, you confirm that you are at least 18 years of age, have read and understood these Terms and our Privacy Policy, and agree to be bound by them. If you do not agree, please do not use our Apps.
Our Apps are wellness tracking tools only. They are not FDA-cleared medical devices, do not provide medical diagnoses, and are not a substitute for professional medical advice, diagnosis, or treatment. Reference ranges shown in the Apps (for lab results, vitals, and other metrics) are general guidelines only — always consult your physician or qualified healthcare provider to interpret your personal results and make health decisions.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
You own all health data you enter into the Apps. We do not claim ownership of your data. You may export or permanently delete your data at any time from within the App's Profile screen. See our Privacy Policy for full details on how we store and protect your data.

The Apps, including all content, features, design, code, and branding, are owned by Tended Tracking and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
The Apps are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of health data interpretation, or uninterrupted availability. We do not warrant that the Apps will be error-free or that defects will be corrected.
To the fullest extent permitted by law, Tended Tracking shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Apps, including any health decisions made based on data tracked in the Apps.
We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page and, where appropriate, by sending an email notification. Continued use of the Apps after changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law principles.
